Introduction This Privacy Policy explains what we do with your personal data in the framework of providing the services we offer on the website www.perfectpixel.es (hereinafter “Platform”), such as the sale and subscription of Business, Corporate, or Premium services, your creation of a customer profile on perfectpixel.es, the possibility of offering and requesting jobs, communications, etc. (hereinafter “Services”). We also explain the policy on the data we collect when you visit the Platform.

Legal basis for processing personal data The collection and processing of your personal data are mainly based on the contractual and/or pre-contractual relationship you have with Us. When we send you our newsletters and Services or use the email you have provided us to contact you in a personalized way or recognize you on your next visit, we rely on informed consent.

The processing of the information collected by our cookies is based on the informed consent you give us, in accordance with current legislation.

Personal information we collect To register on the Platform and to be able to identify you, we will request that you provide us with your email address, full name, position you hold in the company, billing and delivery address, date of birth, and all those data you want to provide us as content base in campaigns.

To create a profile on the Platform, you can include personal information such as your country or city of residence, photo (optional), first and last name, and any other complementary information you wish to share on your profile. The profile information and campaign creation help you make the most of our Services, like helping us better understand the focus of the campaign or job to be done, send us graphic or reference information. In any case, if you do not want this information to be published, do not fill in the corresponding spaces within the profile or delete the information you have already provided (later they will not be accessible from your control panel).

To buy or subscribe to our Corporate, Business, or Premium services, we will ask for your company data. Payment methods will be determined under the terms and conditions previously signed by the client and which will remain confidentially stored by Perfect Pixel Publicidad on its servers. If you request an invoice, we will ask for billing information if necessary.

When you visit or use our Services, We record data such as the number of orders, frequency of use, the dates and times when you perform the Services, the dates of publication and delivery, your files that you have uploaded through the platform. We use login records, when you read our emails, and Internet Protocol (“IP”) addresses to identify you and record your use on the Platform.

We do not make automated decisions based on profiles, beyond the personalization of advertising and the legitimate prevention of Internet fraud.

If payments are made by account charge, the bank number is only used to make the subscription payment. You can modify or delete your bank accounts at any time through info@perfectpixel.es. Remember that security in the use of the Platform also depends on your correct use and conservation of certain confidential keys.

Recommend customers or suppliers related to your profile. Contact you via email, regarding updates or informative communications related to the functionalities, products, or services contracted, including security updates of the Platform, whenever necessary or reasonable for your execution. Attend to the requests or inquiries that you make through the customer service channels available on our Platform. We also use your information to generate aggregate data that does not identify you. For example, generating statistics about our clients’ users, their geographical location, interests, the number of impressions or clicks on a webpage that we develop or manage. 4.1.4 Options

During our filming/photography sessions the photographer/videographer/agency can ask you to collect and process the following data:
Model Name/Guardian Name/Signature or Initials We record your name and signature when you sign this document as a guest through a third-party app SignNow (an online platform that allow us to collect signatures and data. Their specific data protection laws are available before signing the document)
Stamp Picture We storage your picture attached to the document to recognise the person photographed or capture by the camera.

HOW WE USE YOUR PERSONAL INFORMATION Legal basis for processing In compliance with the General Data Protection Regulation (GDPR), the Subject is informed that their personal data, including photographs and videos, will be stored, used, and shared in accordance with applicable data protection laws. The data will be stored securely and will only be accessed by authorized personnel.

Identification details We use your name and picture to cross-check with all the pictures/videos we capture. In this way we can be sure every picture and video we deliver to our clients have all the images rights signed. No further data is collected other than the date when the document is signed and your signature placed either by drawing it on the document or placing your initials.
Session and device details We use session and device details to manage access to our network, to make sure the documents have been signed digitally.
Details about your child We use the information you give us about your child/minor to make sure there is a guardian, mother or father in the moment of signing the document.

SPECIAL CATEGORIES OF PERSONAL DATA We may process information about your data, for example to recognise someone if some scenes need clarification or we find trouble identifying the subject in the pictures or the video.
THIRD-PARTY IMAGE RIGHTS AND CONSENT As a contracted photographer and videographer for our clients, we capture visual content that may include identifiable individuals. It is important to note that we are not responsible for the content or the legal implications of the image rights consent forms
prepared by our clients, which subjects may be required to sign.

LIMITATION OF RESPONSIBILITY
• Consent Forms: We are not involved in the preparation, content, or legal validity of the image rights consent forms that our clients requires subjects to
sign. Any questions or concerns regarding these forms should be directed to our clients’ legal department.
• Data Protection: While we adhere to GDPR guidelines in the capture, storage, and transfer of images and videos, we cannot be held responsible for how our clients uses or stores this content once it has been transferred.

SHARING YOUR INFORMATION WITH OTHERS We value your privacy and do not sell your information to any third parties under any circumstances.
We may give information about you to the following third parties, who may use it for the same purposes as us and also as set out below:
The photographer, videographer who was responsible for the shooting.

HOW LONG WE KEEP YOUR INFORMATION We keep the information that you provide or that we collect only for as long as we need to in line with the reason it was collected. More detail is given below for each category of information. We keep your data for up to indefinitely in order to make sure we have this agreement signed.

EXPLICIT CONSENT By signing the model release document, you give explicit consent to the photographer, videographer and/or Media Agency to capture and use their image in photographs and videos for the purposes outlined in this Agreement. The photographer, videographer and/or Media Agency could show those pictures, videos, compositions or edited versions of the content to show them as part of their portfolio and works performed for their clients.

YOUR RIGHTS After completing the document, a pop-up will emerge asking you if you want a copy of this agreement. You have the right to make a request for a copy of the personal data that we keep about you or to correct the details that we hold about you. You will have to introduce a valid e-mail to receive this document but we won’t have access or storage that email. That information is encrypted and we don’t have access to it. If you would like to know what personal information we hold about you, or would like us to correct the details we hold about you, you should write to the address below or email dataprotection@perfectpixel.es, enclosing proof of your identity (such as a copy of your passport or driving licence) and asking to see your personal information or asking us to correct the relevant information. You will have to give us enough information so we can identify the personal information you have asked to see or have corrected. We do not have to respond to your request until you have given us the information we need. We will contact you within one month of your request or, where we have asked for further information to identify you, within one month of receiving such information.

You have the right to receive the information in a portable electronic form. If your request is by email from the address that we hold for you we will respond by email to that address. You have the right to ask us to erase your personal data under certain circumstances. You have the right to ask us to stop processing your personal data where the processing is based on our legitimate interests. This does not include processing which is in line with our Terms and Conditions of Membership, for example payment processing. If we believe we have a legitimate reason for processing your personal information including for the defence

The Subject may also  withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. INTELLECTUAL AND INDUSTRIAL PROPERTY Perfect Pixel Publicidad S.L.U. by itself or as assignee, owns all intellectual and industrial property rights of its website, as well as the elements contained therein (for example, images, sound, audio, video, software or texts; brands or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by Perfect Pixel Publicidad S.L.U. or its licensors.
